In Design 5 (a firm) v Keniston Housing Association ORC 12 May 1986 a claim for unpaid fees , the defendants counterclaimed alleging negligence and breach of contract which had caused increased expenditure on building schemes subject to a Housing Association Grant . This preliminary issue determined the rights of the defendants against the DOE and their effect on the the defendants` counterclaim.
