Discusses the case Home Brewery Company Ltd v William Davis and Company (Leicester) Limited QBD 31 July 1987, where two questions of law arose for the first time. (1) "Does the owner or occupier of higher land have a right to discharge water percolating through or over his land onto lower land....." and (2) Even if a higher owner has no right to compel a lower owner to receive water.... can the lower owner be guilty of the tort of nuisance in carrying out such operations on his land as prevent the water from flowing naturally off the higher owner`s land?" (This case has also been cited as William Davis and Company (Loughborough) Ltd ).
