Land was acquired following the making of a general vesting declaration under the Compulsory Purchase (Vesting Declarations) Act 1981. After negotiations, reference was made to the Lands Tribunal was made in August 1994. The acquiring authority`s application to the tribunal, to have the reference struck out on the ground that it had been made more than six years after the vesting date, contrary to s10(3) of the 1981 Act, was dismissed by the president. The acquiring authority appealed. Held: The appeal was dismissed.
