"Co-operative Wholesale Society Ltd v Chester-le-Street DC" CA 6 May 1998. A claim for compensation referred to the LT in 1994 following a compulsory purchase of land involving a vesting declaration made in 1986 was not time barred by Compulsory Purchase (Vesting Declarations) Act 1981 s10(3) and Limitation Act 1980 pt 1 becuase those provisions were procedural and capable of being varied by agreement, estoppel or waiver, and there was ample evidential material to support the LT`s finding that the council was estopped by its own conduct from asserting the six year period of limitation.
