"Wilkes v Coal Authority" CA 23 April 1998. The claimant sought a determination from LT under the Coal Mining (Subsidence) Act 1957 s13(1)(b) as to whether land had been damaged by subsidence caused by coal mining. Claimed for remedial works to be undertaken by the Coal Authority and whether subsidence affected fitness of land for intended purposes of residential development. LT allowing claim and the Coal Authority appealed. Appeal dismissed.
