"Hillingdon LBC v Guinea Enterprises Ltd" QBD 24 June 1996. The plaintiff council applied for a final injunction under the Town and Country Planning Act 1990 s187B against 16 defendents in order to restrain unauthorised landfilling and aggregate reprocessing on land within the green belt. The land had been purchased by an off-shore company but the legal estate had reverted to the vendor in default of registration. The judge had to decide whether to grant the injunction and if so, against which defendents and unidentified persons. He also considered whether other land within the borough should be included. Held; allowing the application. The injunction bound any person controlling, administering, financing, holding shares in or otherwise subscribing to or connected with the defendant companies.
