OH 24 July 1997. G successfully established that an assured tenancy granted to P had been based on false information, and sought to reduce the agreement. When P claimed that the action was without effect as recovery of possession would naturally fall within the regulations of the Housing (Scotland) Act 1988, G argued that its action would result in summary ejection in the sheriff court. "Held" the action could not be said to be futile and that such action would effect a termination.
