CA 19 February 1998. Landlords C assigned the lease of a property to J, who in turn granted an underlease to two subtenants. In 1995 the headlease expired and the tenants applied for a new tenancy. C served a counternotice, raising the issue as to wether the tenants were in occupation, and opposing the grant of a new tenancy. The tenants assigned the headlease to B who applied for a new tenancy. B`s appeal against the original application being struck out, was dismissed.
