QBD 22 April 1998. B contracted by S to carry out earthworks for construction of a golf course, using contract loosely based on the ICE 5th edition. When delays occurred B claimed extension of time and associated costs. S contended that this action was brought in breach of the contractual procedures agreed in the amended ICE conditions that had been used. S raised numerous issues which were to be heard as preliminary issues.
