A solicitor from each of the respondents gave an undertaking to B that any monies received from the bank would be used solely for the acquisition of a good marketable title to the respective property. In each case B claimed that they failed to achieve a secure title, for differing reasons. B appealed against a decision to dismiss the claims against the first and third actions. "Held" appeal dismissed.
