CA 27 january 1998. The mineral planning authority (N) approved conditions for the operation, restoration and after-care of the subject land, following the registering of an Old Mining Permission. Applicants B and C (nearby residents) submitted that the decision was in opposition to the EC Directive on environmental assessment, and that such a process be followed. Their application was dismissed in the court below. "Held" directive does have effect - appeal allowed.
