QBD 11 November 1997. R constructed a building which contained in part, office accommodation. This was originally thought to be included in their permitted development rights as statutory undertakers under the Town & Country Planning (General Development) Order 1988. A question mark arose over the interpretation of the Order and retrospective planning permission was unsuccessfully sought. On appeal, the respondents upheld the decision. On appeal to the High Court, R contended that the Order prohibited construction of an office building and not a building with some office space in it. Appeal dismissed.
