Damages - 1998 - Estates Gazette [1998] EGCS 160 (21/11/98) .

"Patel and another v Hooper & Jackson" CA 10 November 1998. P wanted to buy a house and obtained a "Home Buyers Report and Valuation" for their mortgage application. Contracts were exchanged but when P came to move into the house it was unihabitable and he claimed the survey was negligent. Judge awarded P damages equivalent to the diminution of value plus stamp suty, general damages for discomfort and damages for mortgage interest payments, endowment policy premiums and insurance premiums. H appealed, claiming they were only liable for diminution of value plus stamp duty. Appeal allowed.
