"Halifax Building Society v Stansfield and another" CA 22 July 1993 the building society (H) sought possession of property of Mrs S who had arrears of £36,864.87. H commenced proceedings. Mr S asserted a beneficial interest and Mrs S sought a stay so that Mr S could arrange purchase from H. This was refused. S appealed. It was "held" that Mr S could apply to the county court for order for sale under the Law of Property Act 1925 s91.
