In "McKay Securities plc v Surrey County Council", the plaintiffs acquired land in use as a brickworks, to which access was via a roadway over land owned by the Council. The question arose as to whether the grant of the roadway was limited to use of the land as a brickworks, and whether the grant carried the right to maintain visibility splays. Plaintiff succeeded on the first issue but failed on the second.
