Looks at the case of "East Dumbartonshire Council v SoS Scotland and Mactaggart Mickel Ltd" where the judges ruled that when looking at a planning consent, there was no need to import the test of `intention to develop` into assessing whether work has begun on site. Also, very old planning consents are not subject to time limits, once work has begun on site.
