ORB 24 January 1995. In a party wall dispute a third party surveyor was appointed to make an award. Following an appeal by the appellant against this award under London Building Acts (Amendment) Act 1939 s55(n)(i), the matter was transferred to the High Court as ORB, where the respondent claimed additional evidence could not be admitted. Held that the court could admit any relevant evidence.
