A persistent rent defaulter, who paid rent arrears on the day a claim for possession reached court, failed to prevent possession. The tenant argued that no proper notice had been served under the Landlord and Tenant Act 1987 s48, but it was held that a notice of service charges served at the time of the original tenancy agreement was sufficient.
