Condition and termination

Brewer, G.

Condition and termination - 1999 - Contract Journal 19 May 1999, 30(1) .

Examines termination of contract. A common feature of term contracts is that both parties will be entitled to bring to an end the contract upon specified notices and procedures. These 'break' clauses must be operated with caution since the party who fails to strictly comply with the terms of the contract may find that it has been held to have repudiated the contract. Discusses repudiation which is thought to arise in two circumstances: where there has been a breach of a condition of the contract; a breach of a 'fundamental' term may amount to repudiation.
