Describes a recent planning appeal decision relating to reclamation of a quarry through domestic waste disposal. The decision was based on issues of the sustainability of waste disposal, the development plan and harm. Together with the landmark decision in West Midlands Probation Service v SoS Environment 1996 considers the development of this new material consideration - the public perception of harm as distinct from actual evidence of threats to public safety.
