Appeal Court offers no help to noise-afflicted tenants

McIntosh, M.

Appeal Court offers no help to noise-afflicted tenants - 1999 - CSM 8(9) May 1999, 36-37(2) .

Considers whether tenants affected by noise from the day-to-day activities of neighbours due to poor sound insulation between flats can sustain an action against the mutual landlord. Three recent CA decisions seem to indicate that this is not a remedy in the absence of clear lease terms.
