R v Parliamentary Commissioner for Administration, ex parte Balchin". QBD 24 May 1999. The applicants owned a house blighted by a proposed bypass and received no compensation. Two reports by the Parliamentary Commissioner found no maladministration by the SoS Transport. Held: the application to quash the second report was upheld. The Commissioner omitted to find whether any DoT officials were aware of the highway authority's discretionary power to acquire property that was seriously affected by the use of a highway constructed or improved by them.
