ChD 29 June 1994. The lease provided for upwards or downwards rent reviews to be agreed by the parties and, in the case of failing to agree, for the landlord to apply for arbitration. The tenants wanted the court to review the rent, claiming that the landlord should not be allowed to frustrate a downwards rent review by refusing to apply for arbitration. Application dismissed, the construction of the review was clear; provision was made for the rent payable in the event of failing to agree at review.
