CA 9 March 1998. An assisgne tenant is unable to establish that a reply to an offer to treat by a landlord in connection with a surrender of a lease was ever accepted by the landlord and fails to establish any actsh which would estop the landlord from so asserting. The landlord`s release of the liability of the original tenant for rent under the lease operates on its terms to keep alive the debts of the assignee tenant. NB NO PHOTOCOPYING ALLOWED
