CA 29 July 1999. Mrs Crombie and her son who became intervening creditors in the proceedings, obtained a charging order on a 125-year lease of a flat held by the defendant tenant to the creditors. The appeal was based on the wording of the County Courts Act 1984 s138(9C) and whether the holder of a charging order can apply for relief from forfeiture. Also whether the possession order should be set aside.
