CA 10 November 1998. In 1988 the plaintiffs wre offered a loan of £83,000 by a building society towards the purchase of a property for £95,000. The defendants were instructed by the building society to provide a housebuyers report and valuation. The property was purchased in reliance on the report, but subsequently found to be uninhabitable. In 1993 the plaintiffs issued proceedings for negligent overvaluation of the property. They were unable to sell the property and incurring costs of rented accommodation. Whether plaintiffs entitled to indemnity for past and future mortgage interest payments. Whether entitled to damages for discomfort of living in rented housing.
