Discusses a recent Court of Appeal decision in the case "Tesco Stores Ltd v North Norfolk District Council" which related to the development of a new supermarket. The case hinged on a drainage condition attached to the permission, with the Court of Appeal upholding the decision of the High Court that it was possible for a letter or plan to cover two purposes, for example a drainage condition and reserved matters, however the applicant must make this clear when the application is put to the Council.
