Reviews a recent Court of Appeal decision relating to enabling development in the grounds of a listed building: Downe Hall in Dorset. In the decision on "R v West Dorset District Council, ex parte Searle", the Court of Appeal ruled that the Council had made the right decision in approving the application which would safeguard the future of the hall, even though the development would harm the historic garden.
