CA 6 November 1998. The landlord, H, was accused of evading duty to offer tenants, M, first refusal on the sale of a block of flats. M served a notice on H seeking information about the transfer. M did not serve a notice requiring H to sell the freehold to them. M brought an action seeking information about the transfer and a declaration that the transfer involved a 'relevant disposal'. Action was dismissed. Tenants appealed. Appeal dismissed.
