Medforth v Blake and others.
- 1999
- Estates Gazette Law Reports [1999] 29 EG 119-126(8) .
CA 26 May 1999. M ran a pig-farming business and in 1982 charged his farm to Midland Bank in order to secure a loan and overdraft. In 1984 the bank appointed B as a receiver to manage the farming business. In 1988 the debt was paid off and the receivers discharged. M then brought proceedings against B alleging that they had failed to take advantage of discounts on pig feed and were therefore in breach of duty of care. Judge held that B owed M an equitable duty of care. B appealed. Appeal dismissed.
