CA 14 July 1999. The appellant (M) owned a premises, which he let as 15 residential tenancies and used the rent to pay his mortgage on the property. On 30 January 1989, the plaintiff (L) made a vesting declaration and acquired the property. In March 1989 M requested an advance payment under Land Compensation Act 1973 s52. On 8 February 1990 L paid M £27,900. In October 1993 the Lands Tribunal valued the property at £80,000. M applied for compensation due to non-receipt of rent from 30 January 1989 until 19 October 1993, when he received the full value of the property. He claimed to have been unable to buy a similar property due to lack of funds. LT rejected the claim. M appealed. Appeal dismissed.
