Discusses the effect of the Woolf reforms on dilapidationsα claims. The new Civil Procedure Rules (CPR) encourage parties to narrow the issues at an earlier stage by following pre-action protocols. Under the CPR the court dictates the pace of proceedings and the parties are no longer able to use delay as a tactic. Landlords can promote early settlement by making a part 36 offer, which is the equivalent to a payment into court.
