QBD 10 May 1999. The claimants (B) were all 100% owned by Chapter Group, the owner of the freehold and a long lease of two adjoining properties affected by works for the London Underground Jubilee Line Extension. B alleged that the works gave rise to claims in private nuisance and negligence. Held: that none of the claimant companies had sufficient proprietary interest in any of the property to maintain an action in private nuisance or negligence.
