The High Court has ruled that Derby CC went 'beyond fair dealing' in an attempt to force a developer to provide affordable housing. The council required two developers of twin schemes to provide 30 homes suitable for affordable housing. One developer proposed building 32 homes for housing associations, and it was understood that this provided the entire quota. However the council's contract then required the second developer to provide a further 15 affordable homes.
