R v Tower Hamlets LBC QBD 12 March 1990. It was decided that although Newham LBC did have the right under Housing Act 1985 s67 to refer an applicant for housing back to another borough, which had already rejected the applicant as being intentionally homeless because he had left accommodation abroad, Newham should have considered the shortage of housing in Tower Hamlets .
