Rogers v Lambeth London BC. CA 29 October 1999. The defendant council obtained a possession order, but R did not comply with the terms of the order. R claimed damages for breach of repair covenant, so the 2 parties entered into an agreement to cover the rent arrears. The council denied their obligation to repair damages during the period of tolerated occupation of R as a former secure tenant. The claim was heard under s85 of the Housing Act 1985. R awarded damages, to be satisfied by cancellation of the rent arrears. The council appealed. Held, appeal dismissed.
