West London County Court, 27 July 1999. A notice of collective enfranchisement had been served on the then trustee landlords by tenants of flats. The applicant landlord (M) acquired the freehold as nominee purchaser. The respondent tenant (K),who was not one of the participating tenants, then sought to obtain a new lease under the Leasehold Reform, Housing and Urban Development Act 1993 s42. M claimed that as the section 42 notice had been served on the original landlord, it was not binding on the current landlord. "Held" Application succeeded: the section 42 notice did not bind M.
