QBD 5 July 1999. The appellant council (C) served an abatement notice on the respondent (G), alleging that structural defects in the premises of which he was managing agent were prejudicial to health. G appealed, claiming that as he was not the owner of the premises, the notice could not be served on him. This appeal was dismissed by the magistrate, however on appeal to the Crown Court it was held that G was not the owner within the meaning of the Environment Protection Act 1999 s80. C appealed. "Held" appeal allowed; matter remitted to the Crown Court.
