CA 27 July 1999. The claimant builder (ST) made a claim against the defendant (G) for payment for work and materials which had been certified by G's architect. G then counterclaimed, based on schedules drawn up by a building surveyor (S) for defective work and delays. An order was made for a meeting of experts, however S failed to adequately respond following the meeting, and was debarred from acting as an expert witness in the proceedings between ST and G and between G and his architect, although he could give evidence as to fact. G appealed. "Held" Save that S should not give evidence of fact, appeal dismissed.
