When a mortgage lender sues for negligence, it is sometimes necessary to prove not only that the lender had suffered loss, but when that loss occurred. Looks at decisions after the HL decision Nykredit Mortgage Bank plc v Edward Erdman Group Ltd (No 2) [1998] which also considers that identifying a date of actionable loss may also require valuation of the 'borrower's covenant'.
