Monsanto plc v Tilly and others. CA 25 November 1999. The defendant company (M) carried out research into GM crops and held a licence from the Department of the Environment to do so. In June 1998, a group of people founded an organisation with the aim of campaigning against GM crops, by pulling up the crops. The first of these attacks took place in July 1998, with the fist 5 defendants pulling up around 100 plants each. M issued proceedings against the defendants and in January 1999 sought summary judgment as there was no defence to the claim. Application dismissed and T was given right to defend. M appealed. "Held" appeal allowed.
