HL 28 October 1999. F had lived with the tenant of a flat of which S was the landlord, in a stable homosexual relationship since 1976. On the death of the tenant in 1994, F applied to take on the tenancy, but S refused, although was prepared to provide smaller accommodation. F's appeal was then dismissed under the Rent Act 1977, Sch 1, para 2(2), as he was not a member of the original tenant's family or his spouse. "Held" that Parliament sought to extend the meaning of 'spouse' to include persons not legally married but living together as husband and wife. It was found that F qualified to succeed the tenancy.
