LT 12 February 1999. Claimants (W) sought compensation in respect of injurious affection to a petrol filling station. A new road was constructed with no direct access to the service station. As a result trade fell dramatically and in 1996 it was closed. W claimed they had a valid claim for compensation under the Compulsory Purchase Act 1965 s10 because the McCarthy rules were satisfied. "Held" claimants were entitled to compensation.
