In April 1986, Gloucester CC granted a development lease requiring building development by lessee for use within Use Classes Order III IV or X. Ashworth Frazer took assignment of part of the land. Discusses whether the lease contains a user restriction affecting the assignees and whether Gloucester CC has the right to withhold consent to the lease on grounds that the proposed assignee might breach the user restriction.
