"Khan and another v Mortgage Express (No. 2)". ChD 14 January 2000. The mortgagors proposed individual voluntary arrangements when Khan fell into arrears with mortgage repayments, owing £266,000. K placed a value of £210,000 on the property and provided for the balance with other arrangements. K received a small dividend under these arrangements. M sought to redeem £210,000 plus interest on tendering. K claimed the repayment in full. Judgment for the mortgagee.
