CA 29 October 1999. R secure tenant of a premises owned by L. Under conditions of tenancy, L agreed to keep the structure of the building in good repair. R fell into arrears of rent L made a suspended order for possession. R failed to comply with terms of the order. R then commenced proceedings against L claiming breach of express repair obligations. R then applied for the possession order to be rescinded. R paid off the arrears and county court judge discharged the possession order and gave judgment for £4642 on R's claim for damages. L appealed. Appeal dismissed.
