QBD 19 November 1999. B was a developer of private houses. L was a trading standards officer who claimed B had misled two prospective purchasers about the external design of their houses. There were four charges against the developer in respect of false and misleading statements. Magistrates dismissed the charges on the grounds that they were promises as to the future and not statements of existing fact. L appealed. Appeal allowed.
