"R v SoS Environment, Transport and the Regions and another, ex parte Spath Holme Ltd". CA 20 January 2000. The applicant landlord challenged the validity of the Rent Acts (Maximum Fair Rent) Order 1999 which was made by the first respondent under a 'reserve power' contained in the Landlord and Tenant Act 1985 s31. The applicant landlord claimed that the respondents had exceeded their power to legislate under the reserve power. "Held" The order was quashed.
