In the light of the expected Countryside Bill allowing for a right of public access to open country, the article discusses the Occupiers' Liability Act 1984 which will apply to entrants under the new right of access. Argues that government placing the burden of liability on occupiers without compensation will leave the new Bill open to be challenged.
