ChD 3 February 2000. B were the freehold owners of a site in Bolton. The claimant W was the assignee of a 125-year lease of the site, which had orginally been granted to Royal Exchange Assurance. Royal Exchange granted back to the council a sublease of the building. B argued whether a hypothetical tenant was impliedly subject to subletting restrictions. Held, the council's arguments were dismissed.
